H-1 Stamping under F-1 capgap program!!

Hi Guys,

 

              Due to some reasons,I scheduled an appointment in bahamas for H1-B stamping on september 16th 2013 but my h-1 will start from oct 1st,2013 and current status is F-1 cap-gap program.

 

Am i eligible to U.S comeback before october 1st 2013????

Yes, you can. But I would say ask your employer how early you can enter into US on H1 before Oct 1st.

If F-1 students who are taking advantage of "cap gap" travel abroad before October 1, they will not be permitted to return to the U.S. on F-1 status. The H1B beneficiary must apply for the H1B visa and enter the U.S. on H1B status. Generally, the consular officer will issue the visa with a start date that is 10 days before October 1.
