yurkey Posted August 28, 2013 Report Posted August 28, 2013 Hi everyone, My company has started GC EB2 procces for me recently and now I am in the middle of applying for PERM certification. I am working for a consulting company and currently have a contract with a company in the same state/city where HQ of my consulting company is located. I am planning to relocate to another state, after my current contract expires. I was told by my company that it would make my GC process very complicated, becuase I need to stay in the same area where I applied for PERM. My question is - should I stay in the same state untill my I-140 gets approved or my I-486 gets approved? Thanks.
Attorney_15 Posted September 4, 2013 Report Posted September 4, 2013 The AC21 Green Card portability law generally allows people to change jobs while the I-485 application is pending for 180 days. Once the Green Card is approved, one is required to work in the permanent job that one accepted whether that is the original job on the LC and I-140 that were the basis for filing the I-485 or the new job accepted under the AC21 Green Card portability law.
