maya79 Posted August 28, 2013 Report Posted August 28, 2013 I was wondering what would happen to H1B status which is > 6 years of extensions and based on I-140, once AOS is rejected? Will H1B status also revoked? What are the options?
omshiv Posted August 28, 2013 Report Posted August 28, 2013 If you were on H1b status when your 485 gets rejected, you are fine. But why do you think it would be rejected?
Belle Posted August 28, 2013 Report Posted August 28, 2013 Assuming, the I-485 denial is not for a reason that makes you deportable, your remainder of the H1 stays. You obviously won't be able to extend it, unless you have another case in the works.
Belle Posted August 29, 2013 Report Posted August 29, 2013 By the way, there is a difference between AOS rejected and AOS denied. Rejected = opposite of accepted. Denied = opposite of approved.
