PERM applied in 6th year on H-1b, Advise on options ?

Hello All,

My PERM is filed in May 2013 and H-1 max out date is Jan 2014. I have only 1 month to recapture which could push date to Feb 2014.  Current processing times are 5-8 months.

Please let me know if anyone has tried approaching DOL directly or any party like Congressman to expedite PERM processing ?

 

Also in case PERM doesn't get approved by Jan 2014, I have to leave USA and then what are the options  with same or different employer  so that I could come back to US without counting towards new H-1 B cap

I don't think that contacting DOL will expedite the process. You were working on H1 for more than 5 yrs, you should have done with PERM long back ago.

 

Contact some attorney, they might give you better option.

Mine is May 1st week, based on current trend I am expecting to know some result early November. You may know yours too by Jan.

Hey guys, i am with you, its always easy to say you should have got it done earlier but guess what more than 45% of applications get dreadful audits..so it's not an easy process...!
