Changing Job after I140 approval and H1B extension

Hi,

   This is regarding my husband's job.

 

He worked for company A and got his I140 approved through them. His 6 years tenure is over so they filed his H1-B extension last month. He got it extended till 2016(three years).

 

Now he is planning to change his job. The company B is willing to do his GC. So I know that they have to start the whole process again i.e. Labor and I140.

 

Our concern is whether he can have the same Priority Date that he got through Company A?

 

If Yes, what is the process of doing it.

Yes he can. The Lawyer will reference the current I-140 approval while filing the new I-140 after PERM approval.

> What happens if current employer cancel the I-140 even before new employers files I140. As you know its takes about an year to get Labor /PERM.  can i retain the same PD ?

 

> What is the risk if i travel to home country within few months after transfer of H1 ?  is it ncessary to wait for new I140 approval?

1. Yes. You need proof of the previous approved I-140.

2. H1 is separate from your Immigration.
