citgomart1 Posted August 23, 2013 Report Posted August 23, 2013 Hi there everyone, I have a situation and needed your best advise even if it is to leave the country immedieatly. I was working for company A and H1B and I-94 were both till January 2014. The comapny A filed cahpter 7 and completely dissolved its assets and liability in Feburary of 2013. My last valid paycheck was in the end of January 2013. I continually work for another company, company B, with the similar business structure till last month without any H1B approval. Than I explain the situation to my lawyer who was involved from the begining and she manage to get the DOL approved for the company B and now ready to file for H1B. My questions are: 1. Will it be aproved even though I managed to work 5-6 months without proper documentations? 2. Isnt the relationship betweem employee and employer ended immedieatly in this particuler case? 3. what will be the future consequences as I have started the greencard process with company A butis still at a very initial stage of getting DOL (Perm) approved. Did not file the I-140 yet. 4. What should be the right course of action at this point? 5. Does it matter that my I-94 and H1B with comapny A is STILL valid till 01/01/14? 6. What is the repurcussion for the company B who I have worked for 6 months without proper documentations and employer also awrae of it but he needed my skills very badly. Any help and right advice in this regard will be highly appreciated.
pontevecchio Posted August 23, 2013 Report Posted August 23, 2013 I strongly urge you to have the Lawyer explain the situation to you in plain Language. Has B taken over A? Is B an successor in Interest? Are you misreading the situation? Talk to your Lawyer. Help yourself.
citgomart1 Posted August 24, 2013 Author Report Posted August 24, 2013 Thank you for your response. No company B has nothing to do with company A but the nature of the business is same. Plus, lawyer is involved but what I have gathered so far from different forums that my lawyer might be misleading me for the sake of the fees. What the lawyer is explaining is very perplexed and does not make any sense. According to what I read so far it is seems that I am clearly out of status as company A is no longer exsit anymore. Plus Comapny B, which has nothing to do with company A, I have been working for them for the past 6 months without applying for H1B for company B. Please advise if someone can. Help will be appreciated.
pontevecchio Posted August 24, 2013 Report Posted August 24, 2013 Fees are relevant back home. I would suggest you get a second opinion from the firm of Murthy and you may even get somebody speaking your Mother tongue.
citgomart1 Posted August 25, 2013 Author Report Posted August 25, 2013 Mother tongue !!!! hmmmm,,,,well unfortunately english is the only language I am aware off as I may be Indian but I grew up in england and in hostel. I had very little or none interection with my native tounge. Unless it is hard for folks to understand what's being said. Again my question remains.... Also, does Murthy law firm does correspondence over the email in exchage of their service fees?
pontevecchio Posted August 26, 2013 Report Posted August 26, 2013 Give the firm a call and then go ahead. Do not use forums to judge a Lawyers integrity. Give the firm of Murthy a call first and there will be nothing 'VERY PERPLEXED" about your matter. You do not have visit their Office.
citgomart1 Posted August 28, 2013 Author Report Posted August 28, 2013 I dont know why it is becoming a personal issue? That is whole purpose of the forum to seek new and different takes. Nowadays people put God on the pedestal let alone a lawyer. I dont know why I have a feeling that my lawyer is somewhat misguisding me and therefore I put the scenario in this forum to see that who is off and on the line. Integrity is a very fluid term my friend!!!
