Is COS from L1 To H1 approval after Oct 1st possible : Need advice

Hi,

 

I would like to know, Is it possible that we may get COS approval, after Oct 1st?

 

I have not heard anything from my employer yet & I can't check the status as they have not provided us the receipt number. Thanks!

Is this your 1st H1B petition? It is possible.

Yes.. You can get it any time. It won't always be before 1st Oct. If you have some notice period issue with your L1 employer I suggest you ask your sponsoring employer to apply for premium. By law you are supposed to shift to new employer from the date that shows up on your H1B visa. This is typically the date when it gets approved so basically very next day !

If I get approval after Oct 1st, how to nullify the COS, Please do let me know. When should I go out of the country to abandon it.
