jross Posted August 22, 2013 Report Posted August 22, 2013 My EB2 petition was filed for Position A under title A in Dec’2007 and my I140 was approved. Before filing I485, I took up a different Position B within the same organization and ammended my H1B for 3 years. I didn’t restart my PERM process for the new position B. Due to a corporate new designation initiative, Position A exists under a different title (job duties are essentially the same, only under a different title).I'm thinking of going back to this old position to file my 485. Is an I140 amendment necessary? If so, how long does it take and what are the risks of an RFE/denial?
