abhiitpro Posted August 21, 2013 Report Posted August 21, 2013 Hi I am working on L1B visa in US and applied for H1B this year . My spouse is on L2 EAD . I didn't file H4 for her . If i do a COS from L1 to H1 ,she can still work on L2 EAD or it will be cancelled . My consultant said that until i am in US and i doesn't move to my home country for visa stamping , she can still work on L2 EAD, is it correct or not?
jairichi Posted August 21, 2013 Report Posted August 21, 2013 Your wife is on a L2 visa which depends you being in L1. How can she retain L2 when you move to H1? Does it not defy logic for you? Once your H1 is approved she ceases to be on L2 and she needs to file a COS to H4. And on H4 she can not work

And on H4 she can not work +1 , file H4 for your wife asap ,since you filed H1 this year I assume your date would be 1st Oct , so you still have days left to file H4 for your wife and as Jairichi mentioned she can not work on H4.

As soon as you are no longer on L1, the L2 becomes invalid. No but or if. And I suggest you start looking for a better employer, one who doesn't give you wrong advice...
