rashi.sharma Posted August 21, 2013 Report Posted August 21, 2013 Hi, I had two question regarding h1b lottery rejection: 1) How can a candidate check if his employer filed H1b petition for him and that it got rejected ?2) Do rejected petitioners get a receipt number ? Please advice. Thanks a lot in advance!
JoeF Posted August 21, 2013 Report Posted August 21, 2013 You can't. And it wouldn't matter, anyway, since the applicant didn't pay for it. Or did you pay money to the employer? Never pay for an H1. An employer who wants money for an H1 is shady.

I have heard some employers either take money or ask people to work without money on certain projects giving them hopes on filing their H1b visa. If the USCIS gives some identification numbers to lottery-rejected cases also, then such employers will not be able to deceive people on false hopes.

Using the receipt number, you can look up the status on USCIS website. I did that when my H1B was filed and was able to know my petition was approved even before the lawyers formally notified me. In my own case, the lawyers provided me with the receipt number which enabled me track the case on the USCIS website

For H1s not selected, the whole application is returned, unopened. If the lawyer gets a receipt number, the case has been selected in the lottery.
