I have applied for H1 transfer to a small consulting company on 08/07. Started with consulting company on 08/12 with receipt number. Got RFE for the transfer on 08/15, yet to get the RFE document. What are the options for me in case transfer gets denied and I think the old employer has already revoked my H1B. Can I apply for H1 transfer to my old employer with the transfer receipt number now? is this possible at all? If transfer gets denied, is this the end of road for my H1 status and should I leave the country (I still have 1 year left on my H1) Please advice?
jairichi Posted August 20, 2013 Report Posted August 20, 2013 If you check this forum lot of OPs have been suggested by members to wait for approval before joining the new company. In you case it will be better to ask your old employer to start a H1B petition now and do it in premium processing

After working for 5 yrs, you still didn't understand how risky it is to leave old job without new job's H1 approval? If your transfer get denied, you will be out of status. So its better to find new employer. BTW what's the RFE about??

It's the situation I was in that forced me to start with the new employer without approval, I took the chance as I have end client letter confirming the project details and I have clean status for the past 5 years. I have not received the RFE document yet, not sure what is it about.
