learner2009 Posted August 18, 2013 Report Posted August 18, 2013 Hi, I am H1b and as per my I 797 document, my visa expired on 14 Feb 2013, however my I-94 states 14 Mar 2013. Is it safe to assume that i am allowed to stay here legally till 14 Mar 2013. Which date is considered ? -Learner

It doesn't matter if it expires when you are within US.

You can stay till I94 date, but if its beyond 6yr, then I94 date is not true anymore.
