Dkd2182 Posted August 17, 2013 Report Posted August 17, 2013 Can I apply for CHange of status from h4 to f1 this aug when my husbands h1b extension is in process . My husbands h1b expires in feb2014 and so does my h4 his office has applied the extension of his h1b . In this case can I apply for COS FROM H4 to F1 will it conflict with my husbands h1b extension and get rejected for that reason.
shekar11# Posted August 17, 2013 Report Posted August 17, 2013 You can apply for COS from H4 to F1. It will not interfere with your spouse extension. Both are independent.
Dkd2182 Posted August 18, 2013 Author Report Posted August 18, 2013 But I read in forum that if re h1b extension comes before my f1 is approved then I will have 2 status change against my application and h1b extension will is applied as it is in appoved status and my f1 pending will get rejected . Is this true ? Is is not safe to apply. For h4 to f1 when my husbands h1b extension is in process .
JoeF Posted August 19, 2013 Report Posted August 19, 2013 Why would you have "2 status changes"? Your husband's H1 extension is a) not a status change, and b) is independent of your COS to F1. I suggest you don't listen to rumors.
Dkd2182 Posted August 19, 2013 Author Report Posted August 19, 2013 Ya what you say is right joe but I read that once my husbands h1 extension is approved before my f1 the ucis will update the validity of my h4 also . And since they will need to update the validity in the system they will update the approved h1 extension and reject the f1 pending becz they cannot have 2 updates against my visa status . Kindly advice I need to get f1 visa done by this fall or I will have to drop the semister now .
livliv Posted August 21, 2013 Report Posted August 21, 2013 Have you also applied for extension of H4 status along with husband's H1 petition? If yes, then you have two applications pending at the same time and the one approved last will determine your status. Also, in order to file change of status frmo H4 to F1, your I-94 must not have expired. When does it expire?
