Mandakini Posted August 16, 2013 Report Posted August 16, 2013 Hi, Is it possible to not join the H1b employer after Change of status from L1 to H1b, Please help. I am not comfortable in joining new employer at this point of time. Please suggest the ways. Thanks!

Belle Posted August 16, 2013 Report Posted August 16, 2013 If your COS was approved, and you received a new I-94, then you would be out of status if you do not join the employer. Two ways to fix that - leave the country and re-enter on L visa or file another COS to L1.

I do not know the status of my H1b yet. If I do not get approval until October last, When should I need to go out of Country, Do my family also required to go out of Country? Please reply. Thanks!

pontevecchio Posted August 17, 2013 Report Posted August 17, 2013 Yes, If needed the whole family needs to leave and come back. Why cannot you ask the H1 sponsor to withdraw his application?
