I would appreciate it a lot if you can advise: Please help:1) I-140 approved with Priority date of Feb 2008 with Employer A2) Switched to Employer B (Labor certified with Employer B)3) Went back to Employer A 2 months back4) Employer A revoked a few I-140s some time back, but is not sure if mine was revoked or not5) The online status does not have any updates since Dec 2008 (Post decision activity : Approved I-140 was sent)6) Called customer service - they have the same status as online.Now what are my options?a) Is there a way to get the latest updated I-140 status over the phone and talk to someone superiorr than customer service (Employer can call as well)?b) Apply for I-485 and wait for RFE if 140 is revoked? (Will the fee be refunded)c) Apply for I-140 and 485 concurrently?d) Start from the scratch?e) Any other options that I'm not aware of.Please help as my priority date is current, but unable to do anything :(.Thanksharry Link to comment
Belle Posted August 15, 2013 Report Share Posted August 15, 2013 a) Yes. File a FOIA request on your I-140. Or if the employer has a lawyer, they can take an InfoPass to ask that question. Or HR person can do it. b) I'd do that. It is actually an interesting question what happens if the I-140 was approved, then withdrawn due to the lack of the job offer, but then the job offer is re-materialized. It's possible the USCIS will just reinstate the I-140. c) With employer B? Do you have a job offer from them? If so, you may try that. d) I don't see a need yet. e) See the reinstatement option.
