H-1 Extension Visa Stamp with new Employer

My first H-1 Visa was approved in Jan 2011 and stamped (without any issue) at Mumbai Consulate in Jan 2012 with Employer A (valid till end of Nov 2013)

I changed my employer in Oct 2012, employer B filed for H-1 Extension and approved till 2015. 

 

Now I plan to travel India in Nov 2013 and return in Dec 2013, I need to re-stamp my H-1 visa in order to return back in States. Both employers are Big Companies in US. (No consultancy)

 

Since my employer was changed -

 

 

1. I do not qualify for renewing visa : due following condition : TRUE or FALSE?

If I am applying for an H or L (individual) visa, my prior visa in the same classification with the same petitioner is still valid or expired within the last 12 months.

 

2.  If Question 1 TRUE : Do I need to follow same procedure what I followed during my 1st H-1 Visa stamp?

Yes, you have apply for new visa and there will be interview. You are not eligible for "interview- waiver" option.

 

You have to follow the same procedure what you followed previously. Nowadays in India stamping is a 2-day process.

 

Day1-  Fingerprinting and photo will be taken at ASC.

Day2 - Interview at the consulate.
