srikanthrk Posted August 13, 2013 Report Posted August 13, 2013 Hello, I am a recently graduated management student on OPT (F1 visa). A startup in California would like to hire me for unpaid part-time work (atleast 20 hrs/week) related to field of my study (e.g. market sizing, exploring product-market fit in geos outside US, help determine pricing outside US etc). My question is: Will this California based startup be violating any local or federal laws by allowing me to do volunteer/unpaid work without pay? I would appreciate an answer from an attorney. Thanks.
JoeF Posted August 13, 2013 Report Posted August 13, 2013 There are minimum wage laws in the US. The employer should check with a labor lawyer. And this can also help: http://en.wikipedia.org/wiki/Minimum_wage_in_the_United_States
livliv Posted August 15, 2013 Report Posted August 15, 2013 It is okay from Immigration law standpoint and in fact you can do that to count towards your employment period. It can be a problem for the employer because of labor laws. Volunteer positions are generally such that all other persons in that position should also be unpaid volunteers.
