Really appreciate quick response since i need to apply i-485 before date gets retrogated. EB3 PD date was Aug 2007 EB2 PD date was Mar 2012 (USCIS not ported EB3 date to EB2) Both has same Alien number (A#) My company sent letter to USCIS 3 times to port date but they haven't and didn't get response. As you know EB2 date has moved this month to Jan 2008. And my company has filed I-485 with a request letter stating that i have EB3 and port my date to EB2. USCIS has rejected my case and returned all I-485 papers back to me Based on my read in the forums that it is Law that USCIS has to consider old priority date. What is my situation now ? How can i resubmit all papers to USCIS without having one more rejection? and what type of supporting information i need to provide ? It seems my employer tried all the ways. But before that can I do the basic validation to know the issue or concern of the USCIS. For example Can i contact to National Customer Service Center (NCSC) at 1-800-375-5283 with my Alien number to know why they have rejected ? and explain them that i have both EB3 and EB2 cases approved ? kalyan_ac Posted August 13, 2013 Report Share Posted August 13, 2013 You will receive a letter explaining why they were rejected. I do not think calling the 800 number will do any good.Just wait for the letter to arrive and engage an attorney meanwhile. Link to comment

I am also in same boat, finding for solutions/Attorneys who can handle my case. You realize that you replied to a 2-year-old thread? Why didn't you or the employer have a lawyer to handle the application to begin with? A good lawyer can prevent such things from happening in the first place. Now a lawyer will have to fix whatever you or your employer seem to have screwed up, which means more costs. Link to comment
