vaimurthy Posted August 9, 2013 Report Posted August 9, 2013 Hi, I have L1B visa which expired on March 2013 and my I94 is valid till March 2015. My company initiated GC in EB2 category on May 2013. I am looking for new Visa so that I can travel outside USA. Following are the options, 1. I can apply L1A which will give additional 2 years. The problem here is if I don't get my GC, then I have to stay outside US for at least 1 year. 2. Once my I140 is approved, I can apply new H1B visa. In this case, will it come under annual quota ? I heard from one attorney that it will not come under annual H1 limit as my I140 is approved. Is that true? Otherwise I have to wait till Nov 2014 for any travel. 3. Also I had H1B visa earlier which I used only for 2 years. My H1B extension was rejected. Can I still use that H1 petition to get new Visa? Your response will be highly appreciated.
pontevecchio Posted August 9, 2013 Report Posted August 9, 2013 Please do not go Attorney shopping. You would ordinarily be able to go into H1 status having been capped once and used 2 years.
