Hi 

I am in L1A from company A and have applied for h1b from company B

Now my H1B i upgraded to premium on AUg 5 and still there  is no decision'

In the meanwhile my l1a petition is over by sep 29 but i have an i94 until 2016.

 

Now my present company/company A is asking me to return to India

So if i put down my papers on aug end and it is immediately accepted(worst case scenario), what are my options.

 

Can I get h1b stamped from canada in case I have to leave USA

 

What are my options in staying in the US. Since the gap is too small

If all documents are good your H1B approval decision would be mailed to you in 15 days due to premium processing. If you get an RFE then you can leave to India, apply for a H1B visa and enter US

Yeah but I was hoping how can I stay back in US

 

 Incase I get my H1B approved, and I put down my paper and it is immediately accepted, can I put in a COS for L1 to B2 or L1 to F1 and later on withdraw the COS and continue on an approved H1 from Oct1 onwards. Just hoping that if I can withdraw(since it takes some time to get approved) so the Last Action Rule doesn't apply.
