Jackum Posted August 7, 2013 Report Posted August 7, 2013 Hi, I received 221g today.I was on bench for couple of months and have paystub for one month and was on personal leave for another month(I don't have paystub).Now the Visa officer is asking for Bank Statement.I don't have any deposit and Also,my payment's are delayed because the vendor delays.I don't have anything to prove to the Consulate.Only way is I can show the Bank statement with delayed payments.Also the payments are not full(sometimes includes perdium, uneven salary) Please share your Ideas and options available for me.I'm very worried that my Petition might get rejected. JoeF Posted August 7, 2013 Report Posted August 7, 2013 Your "personal leave" just means that the employer essentially told you to go on leave so that he didn't have to pay you. This kind of stuff is not legal. You need to get paid on bench. Period.

Thanks, Jkum I believe this is for a H1B visa. With your condition I do not think you will be able to convince VO. You are out of status for couple of months and you do not have pay stubs. Mostly you application will be denied. Vendor delaying payment is no excuse your employer delaying salary to you

Thanks, Jkum Their are lots of illegal activities done by your FRAUD employer. I would say find another employer. You need to get paid every month on H1, their is nothing called personal leave without pay unless and until you had surgery something like that.Your employer pays you not the vendor, so that's employer's problem. Coming to per-Diem, do you have proof for why you are receiving that amount?? Now you realize the FRAUD activities??

To get some insight, can you say how Long are you on H1B, if you are on OPT before this. How many pay stubs do you have? and missing how many months of pay stubs. As well if you have any w2's for previous years? and if you have changed any employer recently ? Let us knw so we can get some sense to address your needs. Thanks, John

The problem is with Deposition of money for the month of Jan,Feb and March. They requested me to show the proof in form of Bank Statements. I'm working with the current Employer since 2011.I have continuos paystubs starting from last year.Before that I dont have for couple of months. Thanks for all your Replies...
omshiv Posted August 7, 2013 Report Posted August 7, 2013 As others have suggested..leave this ********* fraud shady employer..they care only about their money and not your immigration status..you and your employer have been involved in some illegal activities..now you are paying because of that.
JoeF Posted August 7, 2013 Report Posted August 7, 2013 Again, you need to get paid ALL THE TIME on H1. You can file a complaint with DOL on form WH4 for all H1 violations (like not getting paid) for up to a year back. DOL will make your employer pay you. You are still likely to get into problems for not getting paid further back. And for the future, make sure you get paid ALL THE TIME.

You may have heard of databases and the Internet... The OP has to make sure that he gets paid all the time. THAT'S the only thing that helps.
