JobSeekerSun Posted August 6, 2013 Report Posted August 6, 2013 Hi, One of the companies started my GC processing showing me as a Future Employee. I have got a PERM approval without any hassles, queries. My lawyer is just about to file I-140 and she now realized that the Employers net income is 60K, which doesn't support my proffered wages, which are around 95K per annum. As per me she should have analyzed this before starting process itself. Lawyer is still working on this and have not taken any final decision. Can you please suggest, what options I have now? Thanks
JoeF Posted August 6, 2013 Report Posted August 6, 2013 Find another employer, a real one, not such a fly-by-night operation.
jairichi Posted August 6, 2013 Report Posted August 6, 2013 You do not have any option other than the company dropping the GC process or increasing its net income.

Thanks Nothing you can do here. You shouldn't be getting involved. Based on facts presented, audit is likely and maybe followed by denial. USDOL and USCIS might take a very narrow and strict view when it comes to ability to pay issues.
JobSeekerSun Posted August 7, 2013 Author Report Posted August 7, 2013 Thanks for your suggestions. If suppose I find some other employer, Is my approved PERM of any use ? Thanks
JobSeekerSun Posted August 7, 2013 Author Report Posted August 7, 2013 Also wanted to clarify - My Employers total revenue is 400K and profit is 60K My current Salary is more than PERM Salary, does it matter while applying for I-140? Thanks
