Parimala Posted August 3, 2013 Report Share Posted August 3, 2013 I got my H1 approved for an year in Nov'2012. I went to India and went for stamping in May'2013. But I got a 221(g) saying administrative processing its been 3 months but there is no update. My concerns are 1. while H1b visa is under processing can I apply for H4 stamping simultaneously . Will there be any problem at visa interview?? 2. I heard from some one saying you have to withdraw your H1 and apply for H4 is that true ?? And can you let me know the process for withdrawal. 3. My husbands h1-b will expire in dec. he is planning for extension in couple of weeks will there be any problem for me going to H4 visa??? Your response is greatly appreciated . Link to comment

I was wondering whether I could apply for tourist visa. Does anybody know how to get the passport back from the consulate?? My daughter's school in Los Angeles is opening next tuesday and till now we are not able to go back. We are so frustrated and confused. Link to comment

(1 & 2) Yes, you have to withdraw your H1B application and then apply for a H4 visa. For withdrawing your application contact the customer care of the agency that facilitates visa appointment. (3) You could apply for your H4 visa based on your husband's current I797 but your I94 will be till the date of expiration of his petition. If you apply after his extension approval you would get a visa & I94 valid for longer time, provided his expiry date in approved petition is longer. Link to comment

Applying tourist visa in parallel with h1/h4 shows wrong intention. As H1 falls under immigrant intent, and tourist doesn't. Best of luck for Admin processing, hope you get response quickly. I was told to write a written letter for the withdrwal of my H1. they replied saying " please be informed that it takes 2 to 3 business days to process your request. However, it might differ from case to case, as it is at the sole discretion of the Embassy. " so is there a way that I can take a xerox copy and apply for my H4 visa? I heard some one said you the withdrawal process is easier if you go from your employer . Can you suggest me what is the bvest thing that i do to get the withdrawal asap. I appreciate your help.
