sharmag2208 Posted August 2, 2013 Report Share Posted August 2, 2013 I heard that since I have received a receipt number, i.e. my petition was chosen in lottery this year, I will be cap exempt for next 6 years, regardless of acceptance/denial/ rejection of petition this year. Is this true? Does that mean even if my H1B is rejected this year, I can file through a different employer anytime within next years? Link to comment
jairichi Posted August 2, 2013 Report Share Posted August 2, 2013 No. If you H1B petition is rejected/denied you are not counted against cap for this year. Next year when a new employer applies you are subjected to H1B cap Link to comment
