rainbow123 Posted August 2, 2013 Report Posted August 2, 2013 Friends,Need a quick help, situation is:• 9 years ago CHILD filed for adjustment for permanent residence status along with me and my wife’s I-485 petitions on employment based category (EB3). Mine and my wife’s applications have been approved 6 years ago but my son's application was pending for photo missing reason and we have appeared for fingerprint and photo at local service center and later PD has been retrogressed since then his application is pending .• Last week, me and my wife got Naturalized as US Citizens.• As a child of US Parents, Child is now eligible for I-130 petition under Immediate Relative category. Now do I need to file new I485 again or can I interfile existing one with new I-130 petition? Do you see any risk that Primary Applicant (father) is now a US Citizen ( not on greencard anymore)? they might deny existing I-485 if just fiel I-130 and attach a letter to convert existing employment based 485 to family based? Child is still a minor (11 years old). I appreciate if any one has insight and know the procedure.Thanks
