krishnank Posted August 1, 2013 Report Posted August 1, 2013 Hello My company is having temporary layoffs where everyone who is eligible has to take 1 week off without pay. Now the immigration department is saying that no mkt test can continue due to layoffs. Is there any guidance on whether the layoff be permanant in order to stop the mkt test? These layoffs are temporary and people return to work after 1 week. thanks Krishnan.
JoeF Posted August 1, 2013 Report Posted August 1, 2013 These are still layoffs. And it seems the company is in financial problems, so it is even less likely to get through a GC process, due to lack of ability to pay.
GNH Posted August 2, 2013 Report Posted August 2, 2013 Lawyer is correct, PERM cannot proceed if there are layoff or reduction in work hours of current employees.
