jairichi Posted August 1, 2013 Report Posted August 1, 2013 Hi, My situation is as follows: H1B visa valid till 31st July 2013 I94 expiry 10th August 2013. Resigned from current job on 10th July 2013. Applied for COS from H1 to H4 on 10th July 2013. Received COS receipt dated 17th July 2013. What will be my status if I stay in US after 10th August 2013 (I94 expiry date)? Am I legally allowed to stay when my COS is pending? Actually, I have a job offer in another country and expected to leave US to take the new position by 22nd to 25th August 2013. Thank you for your response
omshiv Posted August 1, 2013 Report Posted August 1, 2013 I believe you should be good as long as the COS is pending..but if its denied or something then you'll have to leave immediately. But regardless it shouldnt be much of an issue as anways you are leaving by 3rd week of Aug. We'll miss you at this forum. You have been a great contributer.

Thanks for the reply and your kind words Omshiv. US was my dream country earlier. But, with all these visa categories and looking at the trouble for having to wait a long time to get a GC I decided to move on with my life by moving to another country that values my skills & expertise. But, even though I move out of US I believe I would be allowed to contribute to this forum with the limited knowledge I have on visa issues. I learnt a lot about US immigration through this forum.
