Strange issue reg. pre-requisites for L-1

Hi,

 

I have worked in a company from March 22 2011 to Mar 2012, and then switched to another company.

 

Now I am planning to move back to the same company. Am i eligible to L-1 visa ?

 

L-1 Pre-req says, worked atleast 1 year in last 3 years, mine is missing by a single day. Although, since 2012 is a leap year i would say 365 days (ofcourse i wanted to think like that) completed in the organisation.  Am i eligible to L-1 visa ?

It does not have to be consecutive time.

Is that outside the US.

The rule says that you have to have worked for at least 1 year in the previous 3 years in a branch of the company outside the US. That does not have to be consecutive.
