Hello,

 

I have done my masters from **** in 2008, My last enrollment was in summer 2008 which started somehere in june 2008, at that time university was accredited. All things were pretty smooth for me. But now as per the university closure what could be i485 outcome.

 

Masters completed in sept 2008

last semister enrolled in june 2008 (Univ accreditation was lost in aug end 2008)

Labor and 140 was approved in 2010.

H1 and Extension was also approved with no worries.

 

 

if there is any problem can I apply GC in EB2 category and port the same old date?

If the degree was conferred after **** lost accreditation, then the degree can NOT be used for an immigration benefit.

You need to discuss your situation with a good immigration lawyer ASAP.

So you have been graduated after **** has lost accreditation. That means you may not qualify for EB2.

But I read somewhere if accreditation is lost in the final semester, that degree should be valid as Univ is accredited with state council.

The rule is that at the time of graduation, the institution has to be accredited.

You graduated after **** lost accreditation, so the degree is worthless.

The state council does NOT accredit anything.

I know that **** and a bunch of similar frauds advertise state council certification as if that means anything.

But again, the state council does NOT and has NEVER accredited anything. It is NOT an accreditation agency. All the state council does is making sure that the institution has enough money to pay the salaries of the teachers.

 

Accreditation is done by approved accreditation agencies ONLY. **** lost its accreditation in August 2008. No but or if.

For EB2, the job has to require at least an MS, or a BS + 5 years progressive experience.

You could have a PhD, if the job only requires a bachelor degree, the case would still be in EB3.

Yeah, I do have BS+5 years experience now and my previous EB2 file was with masters, so now I will initiate new GC filing as BS+5 years experience.

 

But my question is with my new filing can I port my old date??

The previous EB2 was not approvable, so the PD can most likely not be used.

For using an older PD, the old case has to be legit.

To answer your question -- yes you can port the date IF everything else (like job requirement)  etc.  are satisfied.    However,  you have a risk.  Your old 140 might be revoked by CIS since it was approved in error (unaccredited degree)  and if so,  your PD will not be ported.

 

To minimize this ,  ask your employer to revoke the old 140.  If employer revokes 140 you are still eligible for PD porting and it is unlikely CIS will go back and check details of a revoked 140 .     I got this info from an Attorney Blog.

I don't know where you got that from, but it is wrong!

The original I-140 had to be approvable. In this case it was not.

Trying to conceal that and hoping that USCIS won't find out is rather bad advice. They can find out even years later, and revoke everything, including naturalization, because it's all based on an invalid approval.

NEVER try to cheat the system. It will always come back to bite.

But what gonna happen if CIS finds it out?? We cannot take chances here.
