How to find whether my approved 140 was withdrawn

Dear Members,

  My 140 was approved in Jan 2008 and I left US 6 months later. However I moved to the same employer's India office and was with them for last 4 years before leaving them this Jan. Now I would like to check whether they have withdrawn my I140. Kindly let me know how to check this.

 

If there is a similar question posted already in this forum please point me to that.

Do you have the I-140 receipt no? Check on USCIS site.

Also how about asking them?

File an FIOA request. Actually, you probably would not be able to file it from India, but if you hire an attorney in the US, they would be able to. Why do you need to know that, anyway?

Thanks Belle. I am planning to work for a new employer in the US, just wanted to make sure if it is intact. I filed 485 in July 2007 (140 approved in Jan 2008) and only left US after a year of filing 485. Going by the 180 day rule, I presume, the approved 140 could NOT be withdrawn.

 

One important question, is it lawful to apply for EAD and AP from India and re-enter US to take up a Job offer from a different employer ? Kindly provide your thoughts.  Thanks!

Dude..if you are in India right now..then go for CP..your Dates are current.

You need a consultation with a lawyer. It is likely that your I-485 was denied due to abandonment. If it was not, it may still be denied because you were not extending your AP. Get a paid consultation with an experienced immigration lawyer in the US.
