vivek19 Posted July 27, 2013 Report Posted July 27, 2013 Hello I got married recently and moved to the US on H4 visa (husband has h1-b). I am an architect and was working in India with a well established firm. The firm has multiple offices in the US and they are ready to hire me in it's NY office again. But the issue is H1-b visas for the year are exhausted. I tried looking online and looks like they can only file for my h1-b next April, but even then I can not start working until that October, is it really true? If so, why would a firm file for my visa and invest in me when I can't work for them for another 6 months? I wanted to check if there's something else that I can explore. Please advise. Thank You.
jairichi Posted July 28, 2013 Report Posted July 28, 2013 Yes, your employer can apply for a H1B next April with a start date in October 2014. That is the law. But, since you say the employer with whom you worked has offices in US ask them to file for a L1 visa.
