Info2781
Hi there, Recently I changed my company and got my H1B approved and transferred to new employer, my wife has her H4 visa (From my previous employer) valid until Aug 2014. My question is: Now if I go for my visa stamping, can my wife come with me and get her H4 visa stamped for the new employer? Please advice me on this. Thanks, Link to comment
jairichi
There is no need for a H4 visa stamping for your wife as her current visa is valid till Aug 2014. When she enters US at POE she has to show her passport with old valid visa, a copy of your new I797 and hers too. This is applicable till her visa remains valid or your status changes Link to comment
Info2781
I have new I 797, does she also need one? I have not yet applied for her visa extension, since it's going to expire in Aug 2014. Link to comment
pontevecchio
She needs your I-797/H1 approval to return. Link to comment
