Got my H1 stamped in India at that time and valid till sep2013. I relocated and joined a consulting company and dint work for about 6 months. Ran 1 pay check to move to a diff consultancy and H1 approved for 3 years and I have been working from May. I am thinking to go to Canada for stamping in October. Is it advisable to do so as I dont have paystubs for 6months. Any suggestions much appreciated. Thank You, Link to comment

Guest Posted July 24, 2013 Report Share Posted July 24, 2013 Hello Not having pay stubs (meaning not paid) is always a problem, not just for stamping, even in further processings. if its a month or so, u can manage saying health issues, vacation or something but 6 months is huge trouble... its out of status..u can file complaint with DOL about this.. I work for consulting company as well and I always think why I did not choose full time route. Now I cannot go back for many reasons. I know how the life with this consulting companies is. hope u figure out something. Thank you Link to comment

You have been out of status and by luck you have got back in status If you browse through the forum, both Mexico/Canada demand W-2 for past few yrs, bank statements as proof of deposit along with paystubs Since you cannot provide, is it worth the risk ? File a complaint against that FRAUD employer for not paying you for 6 months.This is the ONLY option, if you won't then this will bite you in future. Link to comment

Was that a real paycheck, or was that something fake where you returned the money? If the latter, you are not only out of status, but you would have committed a felony. On H1, you need to get paid ALL THE TIME, and that has to be for real. The employer knows this. File a complaint with DOL on form WH4. And next time, don't wait, and make sure that you get paid FOR REAL ALL THE TIME. Link to comment
