Vinay_raj Posted July 24, 2013 Report Share Posted July 24, 2013 Hello While filing for my H1B renewal, there was a mistake in the calculation of total length of stay in H1B/L1. Even though the dates of entry and exit were all correctly mentioned, the attorney asked for an end date BEYOND the 6 yr limit. Subsequently the petition was approved and visa stamped. This was 3 yrs ago. This mistake was discovered only now and my company is of the opinion that I will be out of status a month earlier (when actual 6 yr limit is reached) even though I have a stamped visa & I-94 permitting my stay beyond that period. Should I leave immediately or continue to stay until the authorized period? Will this cause a problem when I go for H1B 7th year extension? If that is a problem, can I overcome that by filing for a fresh H1B (after 1 yr) instead of extending the current one? Thanks VR Link to comment
