L1A valid for next 2 weeks. Currently in Mexico

Hi,

 

I'm on H1B visa with approved I-140.

 

My husband was on L1A visa (expired April 2012). His I-94 extension is valid until 08/08/2013. He got a work permit for Mexico and left for Mexico this past sunday (07/21/2013)

 

1) Can he apply for H4 visa while he is there at Mexico and get it stamped, so that he can visit us for any personal / family emergencies?

 

2) Until 08/08/2013 (his I-94 extn expiry date), can he re-enter US on L1A visa itself?
