spicy7up
Hi Experts, I am individual with the current H1B and pending EB3 petition with my current employer. I have a new employer who is willing to file EB2 petition. I am wondering, Is it possible to have two seperate petition with two different employer i.e while my current EB3 petition is pending with my current employer, Can my new employer can file EB2 on behalf of me? Do I have to get my H1B transferred to New employer? What happens to my current EB3 petition? When do i have to actually work for my new employer? Can i continue working with my current employer till i get my greencard? Would my current EB3 petition be still valid regardless of out come of new EB2 petition? I am in a great need for help. Please respond/advice so i can make a correct decision. Link to comment
omshiv
Yes, your new employer can sponsor your GC in EB2 (provided you are eligbile for the same). And you can even retain your PD. Get an Immigration Attorney involved in this. Link to comment
