Grace period in change of status from L1 to H1

Hi,

 

I am on L1 visa, and my project ending in August 31 and i need to go back to india. I have applied for H1 and my status will get changed from Oct, 1st. What is my status (illegal or legal), if i stay with my own expenes in US for one month (Sept). Please suggest the available options.

There is NO grace period. You would be out of status.

Usually H1B approval should get before Oct 01, as the status will get changed from Oct 01.

 

1) Is there any chance, that the H1B approval may get delayed, (if there is no RFE or query).

2) If I go for premium processing, will I get approval in 2 weeks ? Is there any chance, that they will put RFE/Query, just to delay ?

Again I ask why do you think the H1 visa will be a problem? If so why would you associate with such employers to realize a dream at any cost?
