L1B to H1

Hi,

 

I stayed in USA for 3 years and 8 months. Below is the split up of my total period of stay.

 

Dec 2008 -  Feb 2009

June 2009 - July 2012

Dec 2013 - Apr -2013

 

Initially i got L1B blanket in 2008 through which i went to USA in Dec 2008. I was able to stay in USA  till July 2012 using this L1B visa as i got my i-94 expiry date more than the L1B blanket visa expiry date (apr-2011).

I came back to india in Aug 2012 and got fresh L1B blanket visa once again and it is valid for 3 YEARS (till october 2015).

I went to USA in Dec 2012 and i had to come back to india in Apr 2013 due to some reasons.

So, my clock has not been reset and my total stay is 3 years and 8 months.

If i travel to USA by Jan 2014 and get H1B visa (i assume it will be L1-H1 conversion) in Apr 2014 while i am in USA, what could be the validity of my H1 visa.

Also, will i be able to reset my clock after getting the H1 in apr 2014 ?

Unless you find a sponsor to apply for a cap subject H1 in April,2014 to start from October you are left with the remainder option of 6 years minus current time in H1 and L1 status.

Thanks for your response.. In case i reset  my  clock by staying in India till Apr 22 ,2014, and meanwhile apply L1-H1 conversion by applying in  Apr 2014 by being in India , will i get 3 years validiity in my H1 ?
