HarshMukadam Posted July 18, 2013 Report Share Posted July 18, 2013 Hi All, PD : April 2007I-485 Filed : 5/2012EAD Received Mid June 2012Moved to EAD from H1B in June 2012RFE Received : Boiler Plate RFE June 2013 My Attorney has responded to the same with following cover letter & attachements, requesting you to give your inputs... To Officer,We have received your letter dated 06/13/2013, requesting the proof of the applicant's continuous employment authorization in the U.S from the date he filed his From I-485 to the present. As applicant is still working for the original I-140 employer, the evidence to prove the applicant's continuous employment with the petitioning employer is provided as follow: 1. Letter from your office dated 06/13/2013.2. Currently dated EVL from petitioning employer.3. Copy of applicant’s all EAD AP Combo Cards (front & back) granted by USCIS since filling of his 1-485. When I asked attorney about attaching H1B (I797) to describe employment from the date we filed I-485, his response was as follow, .....Fortunately, we do not need to explain the employment gap because the RFE only ask for employment authorization. The RFE is not seeking anything in between...... Am I in safe position by not sending H1B 1797 from date I filed I485 & getting EAD ? Thanks Link to comment
