Minimum validity on I797 required for stamping

Hi, I have my H1B visa stamped till Oct 2013 (with old employer) and the I797 however, is valid till 27th Jan 2014 (with new employer).

We are now planning to visit India in Aug/Sep 2013. I will return to US in Sep 2013 however, my wife who is on H4 would be staying back in India till Nov 2013.

 

Can we go for stamping in Aug/Sep 2013 with the current I797 which is valid only until Jan 2014? How many months minimum validity on I797 is required for stamping?

 

I am planning to apply for the H1B renewal after we return from India as the current I797 is valid till Jan 2014

if you have all documents correctly that should be fine to go for stamping
