Raj217 Posted July 17, 2013 Report Share Posted July 17, 2013 I changed jobs recently and PERM was initiated again. I am in the prevailing wage process currently. I retained my PD of Nov 2007 and it became current few days back (for EB2 India). But the bulletin also mentions that the dates might retrogress. So my concern is that by the time my perm is approved (8-10 months from now) my PD may not be current and I might miss the bus. Is there anything I can do at this point to take advantage of my PD going current ? Somewhere on murthy.com I read- "Once the labor certification is approved, the general procedures allow for concurrent filing of the I-140 and I-485. " So really I don't have much hope.. but no harm in asking. Thanks folks for taking the time to read this. Link to comment
Belle Posted July 17, 2013 Report Share Posted July 17, 2013 You can only file if your petition does not require PERM, like an NIW petition. If the PERM is required, then it has to be approved before I-140/I-485 filing. Link to comment
Attorney_22 Posted July 17, 2013 Report Share Posted July 17, 2013 Only if the previous I-140 sponsor is willing to continue to offer you the position in your original labor certification would you be able to file your I-485 in August when your PD is current.
