For 1 month (05/15 - 06/14 2013) and Feb - Sep 2012 before that. I had to come back to India for a period of 1 month in June 2013. I am flying back due to urgent client need for project related work on Aug 06 '13 and will be arriving in the US on 07 Aug '13. I plan to file my L1B visa extension petition through my company once I am in the US. My question is - 1. Will my arrival date in US on 07 Aug (25 days before my Visa expires) cause an issue at the Port of entry in terms of me being denied entry ? 2. Will my latest arrival be a reason for my L1B extension petition to be rejected ? Please advise if there are any points/factors I need to take care of while preparing my L1B extension petition and what can I do to overcome if the above situation may cause issues at my Port of Entry or Eventual visa extension petition. Please advise and help me out. Thanks in advance. By saying preparing the petition, I mean I will only be providing the skillset details, specialized knowledge details. Rest all will be taken care of by our Immigration team. My only concern is - Will there be an issue at the Port of Entry if I land in the US 25 days before my VISA expiry and if this could be one of the reasons for my extension petition being rejected. My visa extension will be filed from the US itself. Only thing stopping us from doing that is the I-94 copy and passport stamp which I will get only after I land in the US. Link to comment
