neotest
Currently I am STEM OPT, I am not sure if my company will file for H1B in April 2014 but I can file for green card on my own and they will provide all supportive documents so it will be company sponsored but I will collect all documents. If I file for green card in EB2 category do I get new H1B automatically once my I140 is approved? I believe once I140 is approved people get their H1B extended for more years, so can someone get new H1B Link to comment
JoeF
Unless your work is really important for the country, you need your employer to file a GC. You can't do that on your own. Link to comment
ge145
You are in confusion of things Currently u r on F-1, which is a non-immigrant visa. A work sponsor green card can be filed when your visa is H1b which is a dual intent visa. That company files for your green card, not you. You do no get H1b bcoz you filed for EB2 green card. t75
It is apparent that your employer is either really new or small if they do not know the GC requirements. You have major problems. See an attorney for a reality check. Link to comment
chakrakr
You are saying "company will provide all supportive documents so it will be company sponsored". If it is company sponsored , company will have to do the PERM process AND pay for it (you cannot pay, nor can company ask for reimbursement). .To do a self GC, you have to be somewhat close to getting Nobel Prize (I am exaggerating a bit but that is the essense) Nobody gets H1 "automatically". H1 need to be sponsored by an Employer (and most fees must be paid by Employer). The only advantage you get with an approved 140 is, you get extensions beyond the 6 year limit of H1. This does not seem to apply to you since you have not yet started your 6 year H1 clock. Link to comment
