SnK81
Hi, I came to USA on H1B visa with a DCC and after 1 year working with them I change my employer. I sent a formal resignation letter to my previous employer and they sent me full and final statement. After that I start following up with them for my Experience letter, they never said no but it's almost 2 years I didn't get it. I sent several mails and one legal notice to them but no answer. On phone they always said yes but it never happened. Now I need this for my I-140 approval. If any one have any idea how I can get it. I am open for legal action. ~SnK81 Link to comment
Attorney_23
Under immigration law, there is no requirement that an employer provide a former employee with an experience letter. Unless you have a contract that says they are obligated to provide such a document, you are unlikely to have any legal recourse against the company to obtain such a letter. Link to comment
SnK81
Thanks Attorney_23 for your valuable information. As my company is not going to provide me experience letter and for Green card I need to prove my work experience with that company, do you have any suggestion for me? Link to comment
