My attorney submitted the second RFE response on April 22, 2013. But, still I did not receive any further update. Normally, how long does it take for the Uscis to take a decision? On the site, it says within 60 days. Is there any other way to follow up on my case status. Please advise. Thanks. Link to comment

Reddysreddy Posted July 12, 2013 Author Report Share Posted July 12, 2013 Hi Om, My employer never really showed me the Rfe's but said that the first one was regarding my education and the second time he said that I will have to submit my experience letters and affidavits from all the employers and co- workers. Will this be a potential risk for my visa stamping. Also, as I received 2 RFE's during mu application processing, is there a chance of another RFE when I go for my stamping? Please let me know. jairichi Posted July 23, 2013 Report Share Posted July 23, 2013 What is your current status now? If you have no job then you can not go for a H1B visa stamping. Find an employer and ask them to file a new H1B petition for you that is cap exempt Link to comment

Thanks Are you on bench?? Is your employer paying you even if you are on bench?? If you are working for client the obviously you need a client letter for visa stamp. Link to comment

Thanks Dont go for stamping unless you are on a project. take all your H1 related docs with you..past RFE does not necessarily mean you might get another RFE..and while stamping its not called RFE. Also your employer needs to pay you while you are on bench..else leave them or file a complaint against that shady employer and lets send them back from where they came from. Link to comment

Your employer (and not the consultant as YOU are the consultant) is correct. Its safer to go for stamping when you are with a Client as the VO would ask for the Client letter and other H1 related docs..again when you are on Bench your employer needs to pay you. jairichi Posted July 25, 2013 Report Share Posted July 25, 2013 If your contract has ended (i.e. you are not working) and not being paid then apply for a change of status in US or else return to your home country. In this way you could avoid being out of status or staying illegally in US. Once a job is available get your H1B visa stamped and enter US Link to comment

Currently you are in Canada, so you will start working once you enter into US on H1. So you need to have job and employment letter during the visa interview Link to comment

As H1 has nothing to do with Canada. But it is NOT OK to go for stamping if you do not have any projects lined up in the USA. Again...VO has nothing to do with what you do in Canada. Link to comment

You may definitely book a slot for visa stamping at your choice of US Consulate. But make sure you have all the H1 documents including the Client letter when you show up for H1 Stamping.
