freelance Posted July 11, 2013 Report Share Posted July 11, 2013 Hi I am changing from employer A to B and i have an approved I140 (its more than 6 months i got 140 approval but no 485 has been filed) from employer A and also received 3 yr extension with my new employer B and will be joining them soon. Though i have a good relationship with employer A, he is only saying that he may have to revoke due to his company's benefits so company A is not audited and will not have any issues. My question 1: Lets say my new employer start GC (with Labor) as soon as i join them. But in the mean time if my previous employer A revokes my approved I140 , will i still be able to retain my priority date of July 2010? or if its revoked will i loose an opportunity to carry PD? Please advise and let me know what can be done to carry forward the Priority Date. Thanks Link to comment

Because some of the forums say i cannot carry forward if my previous employer revokes. And even if he revokes how much time will it take for revoking to complete and can i do something with my new employer within that time so the PD is secure to be used with my new employer. Again thanks for the responses. Belle is right. You can retain your PD even if the I-140 is revoked...unless of any fraud charges. Thanks Dont apologies...I would say not to trust completely on a forum to make decisions on Immigration matters..but the above statement is correct in You can retain the PD even if your previous employer revokes your I-140....afterall members on this forum are just voluntarily putting their time and past experience here...we are no legal people.
