Wrong Priority date on I140

I had an older thread on this topic, can't find it to post again....so new one.

 

My first case is EB3 India with priority date of Nov 2004. I485 pending. Second case is EB2 India. The I140 approval notice for the EB2 case has wrong priority date (a 2013 date) even though my attorney requested the older date while filing I140. The attorney opened a SR to have this fixed, back in April/May. No response so far. Now my priority date will be current as of August 1. What options do I have to pursue this fix?

1. Take an InfoPass and ask what the PD is your I-485 is. Tell them you had multiple I-140s and not sure if the earliest PD was capatured.

2. If not the earliest, create a service request on your I-485 to capture that PD. Give them your earliest I-140 receipt number.

3. If nothing works, talk to a good lawyer.

Just checked the options for the InfoPass appointment and nothing lines up with my case. Is this common? Do I 'fake' a reason for the appointment? If so what?

Just re-read Belle's reply here and I am not sure if I gave the correct picture....

My pending I485 has the priority date from the earlier I140 i.e. Nov 2004. However that is an EB3 case hence not yet current. I have a new EB2 I140 approved but THAT didn't get the Nov 2004 priority date captured. When I call USCIS regarding this, they say only the petitioner (i.e. my employer) or their attorney can do any SRs for I140s. 

 

So not sure how the I485 SR would help.

 

Besides, what reason do I use for an infopass? I went to that website and non of their reasons for an appointment suit me. Do I just 'fake' a reason?
