prav Posted July 11, 2013 Report Share Posted July 11, 2013 Hi, I am in my 6th year of H1 visa and my GC was applied under Eb3 , I-140 is approved . Now I want to change my job. My current employer did not provide a copy of I 140 approvalnotice. I have aplied for the same using FOIA and I got a petition with a priority date and stamp on it but not the approval notice copy. Can my new employer apply for my H1 based on the 1140 petition? Is there any way I can get a I140 approval notice? Link to comment
Attorney_11 Posted July 13, 2013 Report Share Posted July 13, 2013 If one knows the receipt number, one could submit whatever was received with the FOIA response as well as a printout from the USCIS Case Status Online system to show that they are the beneficiary of an approved I-140 in a backlogged category in order to show eligibility for extension of H1B classification beyond the sixth year.
