cassn Posted July 10, 2013 Report Share Posted July 10, 2013 My H1b expired on Oct 1, 2012. On Sep 20, 2012 I filied for my H4 extension and got recepit on Sep 28, 2012. My H4 got approved. The approval notice shows H4 is valid from Dec 12, 2012 to 2015. Was I out of status from Oct 1, 2012 till my H4 got approved on 12/12/2012 or since I filed H4 before my H1 expired, I should be fine. Please reply as the approval date on H4 is scaring me. Link to comment

The USCIS does not typically approve a change of with back date. However, so long as the change of status was filed timely and there is no other status violation, this is not generally an issue for future immigration matters. Link to comment
