H1B --> H4 , while green card in progress.

Hello Experts,

 

I was working as H1B till last month, I have I-140 approved, I-485 is not filed yet. I am in India and would be changing my status to H4. My doubt is what if VO asks that am I willing to do job after going to USA on H4? And of course answer is No, but isn't that green card application in process says something else?

As I was on H1b earlier, my green card is in progress under Eb2. Implies that I have intention to work after I get my green card. But since I am going to apply for H4 under which you should not have such intentions. How can justify if such question is asked.

Basically you cannot work in H4 status and he knows that. You are certainly not precluded from changing status to H1 and working or getting the GC and working. There would seem to be no problem.
